It strongly suggested in "Torn" that Major Lee Adama is the CAG of the fleet. But who cares? Who is the best viper pilot (top gun) in the fleet now? Kat playfully escaped from Lee's pursuit in the exercise. And Starbuck? She disobeyed order and engaged Kat, only flew too close to Kat and damaged both vipers. Though she safely landed her viper even the fuel tank was bone dry, Starbuck was taken away her flight status.
RDM mentioned in the podcast that the final version we saw was different from the one they originally filmed. In the original, Starbuck's viper had a mechanical problem and was leaking fuel. She insisted catching Kat and ended up ran out of fuel. RDM said, so Starbuck ran out of fuel, that's boring. And they changed it to the scene we saw.
I think Kat doesn't care about being the CAG. She is more happy to go out there and kick some cylon butts. She is also becoming the voice for the rest of the viper pilots.
